Terms & Conditions of appointment
Thank you for choosing to appoint EDG:Architecture Ltd for your proposals. Outlined below are our general terms and conditions. Proceeding with our services implies consent to the below:
Terms and Conditions:
Termination of Appointment:
Please be aware that should our appointment be terminated, then any time allocated up to this point will be invoiced on an hourly rate of £65/hr.
Payment Terms:
Payment terms are strictly 14 days from the date of invoice. Any invoices remaining unsettled after 28 days will be subject to interest at 8% over the Bank of England base rate.
Any invoice remaining unpaid after 42 days will be sold to a debt collection agency who will add their own fees to outstanding amounts.
Additional Works:
Additional Architectural input in addition to the above listed services will be subject to an hourly rate of £65/hour+VAT.
Mileage:
Our fee proposal allows for one visit to site to complete a measured survey. Proposals are issued via email pdf, and in paper format. We are currently using Zoom to present proposals to the Client. Additional visits will be subject to mileage at 45p/mile from Harrogate for a return journey plus time at £65/hour.
VAT:
EDG:Architecture is VAT Registered. As such all fees are subject to additional VAT.
Appointment:
For most projects, we would suggest that this is executed as a simple contract confirmed by return letter/email as opposed to a formal contract document under seal. To confirm out appointment we would ask that you sign and return an appointment letter.
This would be based upon the terms of an RIBA Domestic Services Contract. This can be found at: https://www.architecture.com/knowledge-and-resources/resources-landing-page/riba-domestic-professional-services-contract-2018.
Either party can terminate this contract as per Clause 9 of the Agreement. Should this be the case then any outstanding fees will become due on invoice. We reserve the right to invoice at an hourly rate for part completed works.
In the unlikely event of a dispute, then both parties should seek resolution in accordance with Clause 10 of the Agreement.
For larger, more complex works we would request that an RIBA form of appointment is completed by both parties.
Principal Designer Role:
For the purposes of CDM Regulations 2015 it is assumed that EDG:Architecture will be the Principal Designer as defined by the regulations unless instructed otherwise. We do not charge for this role until Stage 4 of the RIBA Plan of Works. At which point a fee can be provided if required.

Additional prints:
Our proposal allows for issue of all drawings in A3 paper format, as well as pdf format. Additional copies of drawings will be subject to print costs of £0.2/A4 sheet and £0.5/A3 sheet. Larger format prints will be invoiced as a direct disbursement from a local print shop. The above is usually only applicable at Stage 4.
Insurance:
As an Architect, the ARB (Architect’s Registration Board) require that we hold Professional Indemnity Insurance. A copy of this policy is available by request.
GDPR:
Please be aware that EDG:Architecture will retain your personal details on file for the specific purpose of sharing this with third parties directly related to your proposals only. For example, other consultants (such as Structural Engineers), Principal Contractors, specialist sub-contractors, or Local Authorities. Each of these parties will also be subject to GDPR policy.
